Is Your Divorce Decree Public?

Once a couple finalizes a divorce decree or the court issues a final decree, the paperwork becomes a matter of public record and the public has access to the entire document.  The extent to which the public has access will vary by jurisdiction and by state. More and more jurisdictions are moving to online access.  This means that any person with a computer and access to the internet, like a cell phone, can search for someone’s decree by knowing their name. While anything sensitive like social security numbers or financial account numbers are redacted, all the other information is shown, including the following:

 

  • Where you physically live, how much your house is worth and how much you owe on your mortgage
  • Where you work, how much income you make
  • How many kids you have, their names, how much child support has been ordered, what is your parenting arrangement
  • Where you bank and how much is in each account
  • What kind of debts you have and the amounts
  • What retirement/investment accounts you have and their current values
